TERMS & CONDITIONS

Eligibility

The competition is open to all Malaysian & Non-Malaysian whom qualifies for the criteria below:

    1. Open to all Malaysian citizens aged 18 years and above.
    2. Open to non-Malaysians residing in Malaysia aged 18 years and above.
    3. Open to local students pursuing a full-time/part-time course based entirely in Malaysia are eligible for this competition.
    4. Open to international students pursuing a full-time/part-time course based entirely in Malaysia are eligible for this competition.
    5. Open to all professionals residing in Malaysia above the age of 18 years.

Criteria

The competition is open to all Malaysian & Non-Malaysian whom qualifies for the criteria below:

    1. 2 – dimension.
    2. Mixed media.
    3. Size: (min. 2ft. x 2ft.) (max. 6ft. x 6ft.).
    4. There is no limitation to the type of medium used.

Entries

  1. All entries must be submitted online. Offline entries will not be entertained.
  2. Entry forms must be completed based on name on NRIC/passport.
  3. Multiple entries are permitted; however, one artwork is eligible for one entry.
  4. Multiple entries with the same artwork will result in automatic disqualification.
  5. Each submitted artwork must be accompanied by an entry form.
  6. Joint entry:
    •  Joint entry is a combination of work or craft done by more than one individual.
    •  Joint entry is permitted. However, only one representative can submit the entry as one submission.
  7. Multiple entries with the same artwork will result in automatic disqualification to all joint members.
  8. Please ensure names are spelled accurately as per NRIC/passport.
  9. Please fill in full home address and the right e-mail address and contact number.
  10. No amendments shall be made in any existing and/or future certificate(s) and/or accreditation(s) due to an error in the entry form.

Judging

  1. All artwork(s) are judged by a range of experienced panellists appointed by Karex.
  2. Final results are at the discretion of panellists.
  3. Judges’ decisions are final and may not be contested.

Shortlisted Artwork(s)

  1. Shortlisted artwork(s) will be contacted via email on 30th September 2025.
  2. Original artworks will be required from shortlisted participants – detailed instructions will be shared via email.
  3. All artworks must be carefully wrapped and delivered according to the guidelines provided.
  4. All shortlisted artworks must be professionally presented and ready for exhibition.
  5. Artists are strongly encouraged to ensure their submissions are professionally prepared, stable, and suitable for gallery display.
  6. Artworks submitted without an appropriate presentation (e.g. unmounted canvases, scrolls, rolled pieces, loose paperwork, or pieces without proper framing or backing) may:
    •  Be disqualified at the organiser’s discretion, or
    •  Be excluded from the exhibition and auction.
  7. Further instructions and presentation requirements will be provided via email upon shortlisting.
  8. Please check your email regularly to stay updated and ensure you do not miss any important information.

Announcement of Winners & Cheque Presentation

  1. Announcement of results will be made online via the website aaa.onecondoms.my on 21st October 2025.
  2. All cheques will be presented as per given NRIC/passport name therefore it is extremely crucial to ensure no errors are made in the entry form.
  3. No amendments shall be made in any existing and/or future cheque(s)/ certificate(s) and/or accreditation(s) due to an error in the entry form.

Plagiarism

  1. All submitted artwork(s) must be original and the sole property of the entrant.
  2. Any artwork found to be plagiarised will result in immediate disqualification.
  3. If plagiarism is discovered or brought to the organiser’s attention at any stage:
    •  The artwork(s) will be removed from the exhibition immediately.
    •  Any titles, prizes, or recognition awarded will be revoked.
    •  The organiser reserves the right to reassign the title and winnings to the next eligible entry, as determined by the panel of judges.

Exhibition and Auctioning of Artwork(s)

  1. All winning entries will be exhibited at ONE Bangsar, Kuala Lumpur from 1st December to 18th November 2025.
  2. All proceeds raised will be channelled to NGO’s catering to underserved communities and those affected by HIV/AIDS as well as other pertinent sexual health issues.

Exclusion of Liability

  1. Any costs incurred in the production of the art piece in participation of Art Against AIDS shall be borne solely at the expense of the artist(s).
  2. Karex reserves the right to artwork ownership and distribution of chosen artworks for global sales and marketing purposes.
  3. Karex shall not be made responsible for any damages, losses and/or liabilities of any arising matters directly and/or indirectly from the manner of conduct in the process of Art Against AIDS.
  4. Any breach of the Terms and Conditions as laid out by Karex may result in automatic disqualification.

Return of Artworks

  1. Any unsold artwork(s) during or after the exhibition period, or those still in Karex’s possession, will be returned to the respective artist(s) upon further notice from Karex.
  2. Artist(s) must collect their unsold artwork(s) no later than February 2026.
  3. A minimum of 1–2 days’ notice is required before collection; last-minute or same-day requests may not be accommodated.
  4. Collection will only be allowed during office hours: Monday to Friday, 10:00 a.m. – 4:00 p.m., unless otherwise stated.
  5. Karex will make no more than two attempts to contact the artist(s). If there is no response, the artwork(s) will be considered property of Karex, and may be dealt with at Karex’s sole discretion.
  6. If the artwork is not collected within the stated timeline, Karex will consider it a voluntary donation to the organiser. Donated artworks may be:
    •  Used for future exhibitions, awareness campaigns, or community outreach;
    •  Digitised or repurposed for educational and advocacy initiatives;
    •  Donated to partner institutions, galleries, or non-profit causes;
    •  All usage will be done with respect and credit to the artist, and not for commercial profit.
  7. Artists are advised to check their email regularly to ensure they do not miss any important updates or notifications.

Disclosure and Use of Personal Data

  1. The PDPA governs the processing of the participant’s personal data (“Personal Data”) by Karex. This Notice is issued to Participants to inform that this is the basis upon which, the processing of the Personal Data is done by Karex.
  2. “Personal Data” may include, but is not limited to, the participants’ name, identity card number, address, email address, phone number, gender and other relevant information provided by the participants during or after the Art Against AIDS Student Competition.
  3. Purpose: The participants irrevocably and unconditionally consent and permit Karex to use, publish or feature the participants’ and/or their pictures (which may include the participant’s name, artwork or any of its related matter) without further notice or compensation for publicity, advertising or any other related purposes in any manner whatsoever, including but not limited to in any of Karex publications, websites and/or any promotional materials connected to the Competition. Personal Data is owned by the relevant participant and does not belong to the Karex.
  4. Transfer: The participants’ Personal Data will be kept confidential by Karex but the participants agree that for the purposes set out in (Clause 2) above, Karex may transfer or disclose such Personal Data to the following parties within or outside of Malaysia:
    •  Other partners or any participating partners which owe a duty of confidentiality to Karex;
    •  Karex’s agents or contractors under a duty of confidentiality to providing administrative, telecommunications, data processing or other services in relation to the Competition (such as but not limited to professional advisers, customer call centre providers, gift redemption centres or data entry companies);
    •  Any affiliates that owe a duty of care to Karex;
    •  Any law enforcement agency and/or regulatory body for compliance with applicable laws, rules, regulations, codes and/or guidelines and/or any person or entity to whom the Karex are under a binding obligation to make disclosure under the requirements of any law, rule, regulations, code and/or guideline and/or order of any competent court of law, law enforcement agencies and/or regulatory bodies.
  5. Access: The participants have the right to request access to and to request correction of the relevant participants’ Personal Data. Nothing herein contained shall limit the rights of any participant under the PDPA.
  6. If the Participants do not wish to receive the latest information about products, news and events updates, rewards and promotions, special privileges and initiatives from the Karex and/or its affiliates, partners and advertisers, kindly email to aaa.onecondoms.my.

Copyright and Intellectual Property

  1. All materials and artwork submitted for the Competition must be the original works produced by the participants (and if consent is required for references to works created by other owners, the relevant consent must have been obtained by the participants and stated clearly under the “CREATIVE RATIONALE” column in the e-form).
  2. All intellectual property rights in the Works shall be vested in the Organisers and shall be and shall remain the Organisers’ exclusive property. For the avoidance of doubt, the exclusive ownership of copyright (i.e. economic right and moral right) in the work(s) possessed by the participants shall cease or deem transferred to the Organisers upon the submission of the Works to the Organisers.
  3. The participants shall also waive any right to claim for such use in the Works and to hold the Organisers, their agencies, representative offices, affiliated, associated or related corporations and their respective officers, servants or agents harmless from any and all liability, loss, damage, costs and expenses which may or could arise from such use.
  4. The Organisers shall be free to retain, alter, publish, advertise, exhibit, archive and reproduce images of any of the works on brochures, calendars, catalogues, postcards, and websites or any kind of medium that the organisers think fit for purposes of marketing and promotion.
